METHOD OF SALE: Tracts will be offered HIGH BIDDERS CHOICE on a dollar amount per acre basis. The top dollar amount per acre bidder will have their choice of any or all tracts with the process repeated until all tracts have been auctioned.
TERMS & CONDITIONS: An irrevocable 10% down payment is due on sale day. The balance due in full at closing on December 22, 2008, when marketable title, possession & warranty deed will be given. Seller reserves the right to harvest the Walnut trees on Tract #1 until March 1, 2009. Successful bidder(s) will enter into a purchase agreement immediately following the sale. Property will be sold subject to owner confirmation, zoning, easements, right of way, reservations, and restrictions of record. Closing Agent fees and title insurance to be split equally between Buyer and Seller. Seller reserves the right to accept or reject any or all bids. Seller will pay for all real estate tax installments due and payable through 2008. Buyer to pay for all subsequent real estate taxes. Sale is not contingent on Buyer financing.
